It is submitted by Ld counsel for the defendants that he would pay the same
before the NDOH.
Affidavit of admission denial of documents filed on behalf of defendants.

Ld counsel for the plaintiff submits that since the defendant has not filed
any document hence no admission denial is required to be made.
With the consent of the parties, following issues are framed :
1) Whether plaintiff is entitled to a preliminary decree of
partition in respect of suit property bearing no X1/1040, Gali
Madarsa, Hussain Bux Bazar, Matia Mahal, Jama Maszid,
Delhi 110006 ? OPP
2) Whether plaintiff is entitled to a decree of permanent
injunction thereby restraining the defendants not to create 3rd
party rights and interest or parting with the possession of the
suit property ? OPP
3) Relief, if any.
No other issue arises or pressed for.
List of witnesses be filed by both the parties within 15 days from today with
advance copy to each other.
The plaintiff is directed to supply evidence by way of affidavit of the
witnesses proposed to be examined to the opposite side atleast 7 days prior to NDOH.
