Sh. K.K. Sharma, Ld. Counsel for defendant.
Final written arguments/submissions on behalf of
defendant are stated to have been filed through e-mode and a
hard copy thereof has been placed on record today. Copy also
stands supplied to Ld. Counsel for plaintiff.
Two applications of plaintiff are on record i.e. one
under Section 151 r/w Order 11 Rule 1(a) CPC for placing on
record one SPA and the other under Section 143(3) of the BSA,
2023 r/w Section 151 CPC for examination of plaintiff.
However, Ld. Counsel for plaintiff seeks permission to withdraw
these applications on ground of technical defects with liberty to
file these afresh.
Hence, in view of submissions made and the fact
that notice of these applications is yet to be issued, both the
above applications are being dismissed as withdrawn with liberty
as prayer for. The fresh applications are now directed to be filed
within three working days from today with advance copy to the
Ld. Counsel for defendant.
List the matter now on 03.05.2025 awaiting filing of
above applications/further proceedings.
