Heard. File perused.
Following issues are settled on the basis of pleadings:-
i. Whether plaintiff and other siblings arrayed
as defendants are entitled to 1/5th share each
in property No. 4248/61, Gali No. 61, Reghar
Pura, Karol Bagh, New Delhi in the name of
their grandfather late Mangla Ram ? OPP
ii. Whether plaintiff is entitled to decree of
permanent injunction as prayed ? OPP
iii. Whether late Mangla Ram had executed Will
dated 01.10.1992 bequeathing 1/4th share of
the property in favour of grandsons viz.
plaintiff, defendant No.1, defendant No.2
AND remaining 3/4th share was bequeathed
to his sons ? OPD1
iv. Relief.
No other issue arises or is pressed for.
List of witnesses be filed within 15 days.

Advance copy of affidavit of witnesses to be examined
by plaintiff be supplied to defendants/counsel.
Since plaintiff and defendants No.1 and 2 being
brothers are in possession of 1/4th share of the property by virtue of
Will dated 01.10.1992 of late Mangla Ram so matter may be referred
to Delhi Mediation Centre, THC, Delhi for exploring settlement.
Signatures of plaintiff, defendants No.1 & 2 and their
counsels have been obtained upon ‘Referral Form’.
Parties are directed to appear before Delhi Mediation
Centre, THC, Delhi on 25.09.2026 at 02:00 PM for exploring
amicable settlement through
“Mediation for the Nation Campaign”.
Put up on 16.11.2026 for settlement report/PE.
