An application under Section 39 read with Order XXI Rule 5
and 6 CPC for issuance of transfer certificate has been filed by the DH
through Mr. Shahnawaj Ali, Advocate.
Ld. Counsel for DH requests for issuance of transfer
certificate as the JD is the resident of District Shamli, UP, which is beyond
the territorial jurisdiction of this Court. He further requests that the petition
be sent to concerned Ld. Principal District and Sessions Judge, District
Shamli, UP.
Heard. Record perused.
As the JD resides beyond the territorial jurisdiction of this
court, in view of Section 39 CPC and on request of the DH, Transfer
Certificate be issued for the court of competent jurisdiction as per rules.

The execution petition alongwith requisite certificate be sent
to the concerned Ld. Principal District and Sessions Judge, District Shamli
UP, for execution of the same against the JD, subject to placing on record
certified copies thereof.
Application stands disposed off accordingly.
The DH is directed to appear before the Ld. Principal District
and Sessions Judge, District Shamli, UP on 30.10.2026.
File be consigned to Record Room after completion of
necessary formalities as per rules.
