JD No.2,3 and 4 are ex-parte vide order dated
16.03.2026.
None for JD no.5.
The SPA of JD No. 5 Sh. S.P Sharma is not present.
Objections filed on behalf of JD no.5 are pending
disposal. Reply is stated to have been filed.
Put up this execution with the main file for
consideration.
Further, the DH is directed to place on record all the
orders passed by Hon’ble High Court in the appeal preferred by JD
No.1 and JD no.5.
It is stated that the appeals preferred by JD No.1 and
JD No. 5 were listed before the Hon’ble High Court on 17.09.2026.
It is submitted that the stay granted in favour of JD No.1 has been
continued till further orders, whereas no stay has been granted in
favour of JD No.5. It is reported that the next date of hearing before
the Hon’ble High Court is 09.04.2027.

Ld. Counsel for the DH submits that there is no
impediment in proceeding further and deciding the objections filed
by JD No.5. He submits that all the JDs are in collusion and they
are enjoying the money of the DH.
It is 12:15 PM now. None has appeared for JD no.5
till now.
Today, this court refrains from proceedings JD No.5
ex-parte.
It is clarified that if JD No.5 is not present on the
next date of hearing for addressing arguments on his objections
then no further opportunity shall be given for the same.
Put up for placing on record the orders of Hon’ble
High Court as directed as well as arguments on objections of JD
no.5 as last and final opportunity on next date of hearing.
JD no.5 is burdened with the cost of Rs. 10,000/- to
be paid to the opposite party for being absent today and matter
being adjourned. Addressing arguments on his objections will be
subject to prior payment of this cost.
Re-notify on 29.10.2026 at 12 Noon.

At this stage, Ms. Meenakshi Sharma, Ld. Proxy Counsel
for JD no.5 has appeared. She has been apprised of today’s order
and next date of hearing.
Ld. Proxy Counsel for JD No.5 has filed application under
Section 47 read with Section 151 CPC along with affidavit along
with copy of affidavit of JD no.1 for rendition of account filed in
CS DJ No. 615566/16 in case titled as Sharda Bansal & Ors vs Ram
Dev Bansal on 24.05.2024. Same is taken on record. Spare copy
placed on record.
