Present: Sh. Jitender Shankar, AR of complainant company.
The complainant has filed the complaint for the offence
punishable under Section 135, 138 & 150 of the Electricity Act, 2003 and
along with criminal complaint, complainant has also moved an application
under Section 175 (3) BNSS seeking directions to the police for registration
of the FIR.
Submissions heard on the application of complainant under
Section 175 (3) of BNSS, 2023.
It is submitted by AR of the complainant that the complaint
alleging the theft of electricity, which is a cognizable offence under
Electricity Act, 2003, was given on behalf of complainant at PS Hauz Qazi
on 16.08.2025 and representation was also given to Office of DCP, Central
on 02.09.2026, however, no action has been taken by the police upon the
complaint, hence present application u/s 175(3) BNSS has been filed on
behalf of the complainant.
The SHO concerned to file report about the action taken on
the complaint of complainant in accordance with law and if no action has
been taken then to explain the reasons for not taking the action despite the
circulars issued by the Office of Joint Commissioner of Police, Central
Range, Delhi on 16.02.2026 and 26.02.2026 for strict compliance of
directions in relation to complaints received from BSES/DISCOMs.
Be put up on 26.11.2026 awaiting the report/ further
proceedings.
Copy of this order be sent to SHO concerned for his
information and necessary action.
