Two applications have been filed on behalf of the applicant; (i) an
application under Section 151 CPC for waiver of cost imposed vide order dated
10.09.2025 and (ii) an application under Section 5 of Limitation Act, 1963 read
with Section 151 CPC for condonation of delay in filing application under
Order 9 Rule 13 read with Section 151 CPC.
Copy of both the aforesaid applications has already been supplied
to Ld. Counsel for the non-applicant/plaintiff.
Ld. Counsel for the non-applicant/plaintiff submits that he does not
want to file any reply to the aforesaid applications of the applicant.
In view of the submissions, made in the application, cost of Rs.
3000/- imposed vide order dated 10.09.2025 is reduced to Rs. 2000/-. Applicant
is directed to deposit the cost of Rs. 2000/-, in terms of order dated 10.09.2025,
with DLSA, Central forthwith. The aforesaid application is disposed off.
Arguments are heard on an application of applicant under Section 5
of Limitation Act, 1963 read with Section 151 CPC seeking condonation of dely
in filing the application under Order 9 Rule 13 read with Section 151 CPC.
Put up for clarifications, if any/orders on 23.12.2025.
File pertaining to execution No. 776/2018 be put up alongwith this
file.
