Defendant is Ex parte. Defendant in person. Heard. Perused. Evidence by way of affidavit of PW-1 Avinash Sharma filed. Defendant seeks time to move the appropriate application and he submits that the copy of the plaint and the documents annexed thereto were not supplied to him due to which he could not file the WS and also could not engage the counsel. He also submits that he cannot cross examine the witness as he has not engaged the counsel. On the other hand, Ld. counsel for the Plaintiff wants to place one additional document on record which was not filed at the time of filing the plaint. Heard. Perused. Both the parties are at liberty to move the appropriate applications with advance copy to each other atleast one week before the NDOH. Put up on 11.02.2027. This is the shortest possible date in view of time bound matters and old cases and other urgent matters and this court is giving the priority to these cases in view of the mandate of the Hon'ble High Court of Delhi.
