Accused Pinki on bail in person with Ld. Counsel Mr. Mithun Singh Rajput. Accused Javed produced from JC with Ld. Proxy Counsel Mr. Manmohan. Arguments on charge heard. Record perused. Prima facie case is made out against the accused persons namely Javed Ali @ Chhotu S/o Munne Ali and Pinki D/o Sh. Hukum Chand for the offence punishable U/s 21(c)/25/29 NDPS Act as the material available on record is sufficient to presume the commission of the aforesaid offence by both accused persons. Accordingly, charge in respect of abovesaid offence framed against the accused persons separately to which they pleaded not guilty and claimed trial. Arguments also heard on application already filed on behalf of accused Pinki regarding her arrest. Ld. Counsel for accused Pinki submits that initially accused Javed was arrested and his mobile phone was seized. However, even after seizing his mobile phone, calls were made and accused Pinki was called at Najafgarh at about 09.30 am, thereafter, she was arrested. According to him, as per her arrest memo, the place of arrest of accused Pinki is referred as office of ANTF. He submits that since the accused was arrested at Najafgarh but she was shown to be arrested from the office of -- 1 of 2 -- -2- ANTF, therefore, her arrest is illegal. Arguments heard on the application. Issue summons to witnesses mentioned at serial no. 1 (SI Ram Kishan), 5 (DO/ASI Mukesh Kumar) and 12 (Reader/ACP/ ANTF Crime Branch) in the list of prosecution witnesses for next date of hearing. Case property, if any, be also summoned for next date of hearing. Issue notice to IO to appear in person on the NDOH. Put up for PE/ orders on abovesaid application on 12.12.2025.
