Fresh complaint case received by way of assignment. It be checked and
registered.
Present : Sh. Binay Kumar, AR of the complainant company.
The present case pertains to impugned bill dated
04.08.2026, due on 19.08.2026 and print date 12.08.2026, for a
sum of Rs. 4,08,968/-, raised on the basis of raid conducted on
01.08.2026 by the officials of complainant company and
consequently, the present case has been filed today i.e. 09.09.2026
On being enquired, it is submitted by the AR for the
complainant that the present matter related to property in question
where the raid has been conducted, as noted above, has not been
settled till today with the accused persons and the fact regarding
age of the accused persons has not been mentioned in the
complaint. On being further enquired as to how many cases /
inspections are / were pending with respect to premises in
question / accused persons, AR for the complainant company
submits that he is unable to provide the said details.
Further, on being enquired, it has been submitted by
the Ld. Counsel for the complainant that application for
registration of FIR has been filed on 01.08.2026 by the Assistant
Manager / Authorized Officer and on being further enquired as to
whether the same has been followed-up or not, then no proper
reply has been filed.
On perusal of the record, it reveals that no
photograph of the user / RC / owner has been placed on record
and only one photograph has been filed which is also not clear.
Further, parentage of accused No.1 has also not been mentioned in
the complaint.

Heard. Record perused.
As per section 223(1) BNSS, 2023, cognizance of
the offence can only be taken after giving the accused an
opportunity of being heard.
Accordingly, issue notice to the accused persons
subject to filing of fresh photograph and subject to furnishing
complete details of accused No.1, through SHO concerned and in
addition dasti be given, on filing of PF within seven days from
today, returnable for the next date of hearing. Further, if in the
meanwhile matter has been settled between the parties, then
complainant is directed to intimate regarding the settlement to the
court immediately along with copy of order. Complainant is also
directed to provide list of cases / inspections, if any, which are /
were pending with respect to premises in question / accused
persons on the next date of hearing.
Meanwhile report be also called from SHO
concerned in respect to the submission made above qua making of
complaint to the SHO concerned.
Copy of complaint be also filed along with PF.
Put up for report on the notice on 27.01.2027.
