RAM KISHORE Vs. MURARI LAL SONI
01.07.2026
V.C. is not working properly as there is problem in
internet connectivity.
Present: Plaintiff in person.
Sh. Mukul Sharma, Ld. counsel for the defendant
alongwith defendant in person.
Today, the matter is listed for arguments on the
application moved by the plaintiff under Order VI Rule 17 CPC.
At this stage, plaintiff seeks an adjournment on the
ground that the main counsel for the plaintiff is not available today
due to certain personal exigency and, therefore, is unable to address
arguments on the aforesaid application.
The request for adjournment is opposed by learned
counsel for the defendant, submitting that the plaintiff has already
availed several opportunities to address arguments on the said
application and the matter has been repeatedly adjourned on one
ground or the other.
Heard. Record perused.
Perusal of the record shows that on the last date of
hearing also, the matter was adjourned on the ground that learned
counsel for the plaintiff was required to attend an urgent matter
before the learned Court at Karkardooma Courts. It is also apparent
that sufficient opportunities have already been granted to the plaintiff
to advance submissions on the application under Order VI Rule 17
CPC.

However, considering the request made and in the
interest of justice, one last and final opportunity is granted to the
plaintiff to address arguments on the said application.
It is further noticed from the record that the amended
plaint, which has been filed along with the application under Order
VI Rule 17 CPC, is not in the form required under law. The said
amended plaint is neither signed by the plaintiff nor supported by the
requisite affidavit. The plaintiff is directed to cure the aforesaid
defects and place on record a duly signed and verified amended plaint
along with the supporting affidavit on the next date of hearing.
Advance copy of the same shall also be supplied to the opposite party.
Accordingly, the matter is adjourned for filing of the
duly amended plaint and for arguments on the application under
Order VI Rule 17 CPC, which shall be treated as the last and final
opportunity granted to the plaintiff.
Put up on 06.08.2026.
