Present: Sh. Omveer Singh , Ld. Counsel for the petitioner.
Certified copy of criminal record filed. However,
the copy of the MLC is not on record. Ld. Counsel submits that
the copy of the discharge summary is already on record.
Allowed.
The petitioner has already made Nodal Officer of
insurance company, as respondent no. 4, in terms of the case
titled as “Gohar Mohammed Vs. Uttar Pradesh State Road
Transport Corporation & Others” 2022 SCC Online SC 1769.
Hence, the petitioner(s) is given time to apply to the concerned
Tribunal to send the statutory petition under Section 166(4) of
The M. V. Act (along-with documents/FAR/IAR/DAR) to the
present Tribunal and to comply with the other directions
mentioned in paragraph no. 64 (xii) of above cited judgment of
Hon’ble Supreme Court of India, if required in present matter.
He undertakes that only this claim petition will be
pursued by the petitioners. The petitioner is directed to file an
affidavit in this regard along with the certified copies of the
criminal record by the NDOH.
To expedite the present proceedings and on the
undertaking of Ld. Counsel for the petitioner, notice be issued to

all the respondents on filing of PF/RC for the next date of
hearing. However, final claim order will be subject to the
production of the appropriate order by Ld. Counsel for the
petitioner from the concerned court of MACT, PS Tronica City,
District Ghaziabad, U.P. Summons also also served dasti.
Put up for further proceedings for 24.07.2026. Copy
be given dasti.
