As per the report on notice issued to the defendants through
registered speed post, the same have been refused by the defendants. Ld
counsel for plaintiff has also filed the affidavit of service along with postal
receipts and tracking reports showing that the defendants refused to accept
the service of notice issued vide order dated 22.11.2023 on 18.12.2023
and on 19.12.2023. The said refusal on the part of the defendants, thus,
amounts to proper service of the defendants despite which the defendants
have failed to enter their appearance.
Plaintiff has filed an application u/O.XXXVII Rule 2(3) read
with Section 151 CPC.
