The matter is at the stage of consideration.
Ld. Counsel for the plaintiff has filed on record an application under
Order VI Rule 17 CPC as well as an application under Order 1 Rule 10 CPC,
seeking impleadment of the owner of the suit property i.e. Sh. Gaurav Dhamani
s/o Sh. Gopal Dhamani, who is stated to be the owner of the property.
Keeping in view the fact that, the present suit is the suit for
possession and also keeping in view the fact that, Sh. Gaurav Dhamani is stated to
be the owner of the property in respect of which the present suit for possession has
been filed and also keeping in view the fact that, the suit is at an initial stage, it is
deemed appropriate that the application under Order VI Rule 17 as well as the
application under Order 1 Rule 10 CPC is allowed and the Amended Memo of
Parties as well as the Amended Plaint be taken on record.
Issue summons of the present suit alongwith interim injunction under
Order XXXIX Rule 11 CPC upon the defendants on filing of PF and speed post.
The plaintiff is at liberty to serve the defendants through electronic mode through
the Nazarat Branch on filing of affidavit stating the e-mail address belongs to the
defendants.
