The entire set of the present appeal along with copy
thereof has been filed by Ld. Counsel for the appellant. Same are
taken on record.
The present appeal has been preferred against
judgment dated 03.07.2024, passed by Ld. ACMM-02, Central,
Tis Hazari Courts, Delhi, convicting
inter alia the appellants for
the offence under Sections 326/341/34 IPC and the consequent
order of sentence, dated 11.09.2025, awarding imprisonment for
a period of six months along with fine of Rs. 20,000/- each in
default of payment of which further undergo simple
imprisonment for 14 days for the offences under Section 326/34
IPC; and fine of Rs. 500/- each in default of which to undergo
simple imprisonment for one day for the offences under Section
341/34 IPC.
Ld. Counsel for the appellants has briefly apprised
this Court of the facts of present case as well as grounds of
challenge. Further, Ld. Counsel has also moved an application
under Section 5 of Limitation Act, seeking condonation of delay
in preferring the present appeal. Ld. Counsel has further
submitted that he would place on record, the e-filing receipt in
support of his application under Sec. 5 of the Limitation Act. Let
the same be done, as prayed for.

Issue notice of the appeal and applications filed on
behalf of the appellants, to the State. Ld. Addl. PP for the State
accepts notice on behalf of the State. A copy of appeal,
application(s) and documents annexed thereto have been
supplied to the Ld. Addl. PP for the State.
Further for the reasons stated under the appellants’
application under Section 389 Cr.P.C./Section 430 BNSS,
submissions addressed by the Ld. Counsel for the appellants and
Ld. Addl. PP for the State and the grounds under the present
appeal, demonstrating a
prima facie case, the operation of
impugned order of sentence is suspended till the next date of
hearing, on the appellants furnishing personal bond in the sum of
Rs. 15,000/- each (Rupees Fifteen Thousand only) along with
one surety in the like amount to the satisfaction of the Ld. Trial
Court within a period of fourteen days from today.
In the interest of justice, list for arguments on
26.11.2025.
TCR be requisitioned two days prior to the next date
of hearing.
A copy of this order be given
dasti to Ld. Counsel
for the appellants.
A copy of the order be sent to the Ld. Trial Court for
intimation.
