Fresh complaint case received by way of assignment. It be checked and
registered.
Present : Sh. Binay Kumar, AR of the complainant company.
The present case pertains to impugned bill dated
13.07.2026, due on 28.07.2026 and print date 28.07.2026, for a
sum of Rs. 2,43,523/-, raised on the basis of raid conducted on
10.07.2026 by the officials of complainant company and
consequently, the present case has been filed today i.e.
31.08.2026.
On being enquired, it is submitted by the AR for the
complainant that the present matter related to property in question
where the raid has been conducted, as noted above, has not been
settled before any of the forum till today with the accused and the
fact regarding age of the accused has not been mentioned in the
complaint. On being further enquired as to how many cases /
inspections are / were pending with respect to premises in
question / accused, AR for the complainant company submits that
he is unable to provide the said details.
Heard. Record perused.
As per section 223(1) BNSS, 2023, cognizance of
the offence can only be taken after giving the accused an
opportunity of being heard.
Accordingly, issue notice to the accused, through
SHO concerned and in addition dasti be given, on filing of PF
within seven days from today, returnable for the next date of
hearing. Further, if in the meanwhile matter has been settled
between the parties, then complainant is directed to intimate
regarding the settlement to the court immediately along with copy

of order. Complainant is also directed to provide list of cases /
inspections, if any, which are / were pending with respect to
premises in question / accused on the next date of hearing.
Copy of complaint be also filed along with PF.
Put up for report on the notice on 18.01.2027.
