Fresh RCT appeal is received. It be checked and
registered.
Present : Appellant with Ld. counsel Sh. Manoj Kumar
Duggal.
Heard.
The present appeal has been preferred challenging
the judgment dated 16.09.2025 whereby eviction order has been
passed against the appellant and cost of Rs.1 lac is also imposed
upon him.
The appeal is accompanied by an application for
stay of the operation of order dated 16.09.2025.
Heard.
Keeping in view the facts and circumstances, it is
ordered that the operation of impugned order shall remain stayed,
subject to deposit of Rs.12000/- by the appellant towards user
charges, from the date of eviction order, on or before 10th of each
English calender month before the Ld. ARC and the same be not
released to the respondent/landlord till the disposal of the present
appeal and decision for release shall be taken alongwith final
disposal of the appeal. Application stands disposed of.
Issue notice of the petition for service upon
respondent on filing of PF and RC, within seven days from today,
for 19.11.2025. TCR be summoned one day prior to the next date
of hearing.
