Present: Plaintiff in person.
None for defendant.
Members of the Bar are abstaining from work today.
As per report on the notice, cousin brother of the
defendant namely Sh. Anil Kumar Gupta met the Processor Server
and he talked with the defendant on phone and refused to receive the
notice. I am of the view that defendant is duly served on 05.09.2026.
As per report on the speed post cover, defendant refused to receive the
speed post cover.
30 days time is not expired. One opportunity is granted to
the defendant to file WS, statement of truth and affidavit regarding
admission/denial of documents within statutory period with advance
copy to opposite side.
Plaintiff is directed to file replication and affidavit
regarding admission/denial of documents, if any document is filed by
the defendant with advance copy to opposite side.
Put up for completion of pleadings, admission/denial of
the documents and framing of issues on 16.11.2026.

It is submitted by plaintiff that he is having mobile
number of the defendant. Copy of the order be sent to the defendant
on his Whatsapp mobile number. Plaintiff is also directed to file the
affidavit in this regard.
