Despite several calls none has appeared for the appellant.
Record reflects that there is no appearance on behalf of the
appellant since last two dates of hearing nor appropriate steps
regarding service of notice have been taken by the appellant.
The ld. Trial court order dated 18/09/2024 reveals that
convict has paid the fine amount to the complainant and nothing
remains due as order on sentence stands complied with.
In such circumstances, it appears that appellant is no more
interested in pursuing the present appeal and the application
seeking condonation of delay. Ergo, the present appeal alongwith
the application seeking condonation of delay is hereby dismissed
in default as well as for non prosecution.
Appeal file be consigned to Record Room. Copy of this
order be sent to ld. Trial Court for information and necessary
action.
