Defendant no. 1 in person and on behalf of defendant no.2.
It is informed that defendant no. 3(e) already expired.
2. The present application under Order 9 Rule 4 CPC has
been filed seeking restoration of the suit.
3. Copy of the order whereby the suit was dismissed is
perused. On the date of dismissal of the suit, only defendant no. 1 and 2
were contesting parties and other defendants were already
ex parte.
4. Now, Ld. Counsel for defendant no. 3(e) and 3(f) states
that he has no interest in the present suit and he does not want to
participate in the present application as well as the suit. Accordingly, he
is at liberty not to participate in the said proceeding.
5. Adjournment is sought on behalf of defendant no. 1 and 2
to file reply to the application. Same be filed within 30 days with
advance copy to opposite side.
6. Put up for argument on the said application on 23.07.2024.
