he is in custody since 22.06.2025. Chargesheet has already been
filed and three out of four eye witnesses have already been
examined. None of the prosecution witnesses have supported the
prosecution case till date. PW1 has admitted that he has not seen
the incident and have no knowledge of it. He further stated that

prior to the incident. Hence, he be granted concession of bail.
Ld. CPP for the State, on the other hand, submitted
that the allegations against the accused/applicant are grave and
serious in nature and thus, the bail application is liable to be
dismissed.
I have considered the rival submissions and have
gone through the case file.
On 17.06.2025, on receipt of GD no. 26A, SI Anuj
reached Hindu Rao Hospital and obtained MLC no.5276/25 of
Karan Kumar, who was declared brought dead. After getting the
body preserved, SI Anuj reached Special Home for Boys, Majnu
Ka Tila where he found that deceased Karan Kumar had scuffled
with accused Mohd. Saddiq and Anshu in the bathroom on
15.05.2025. Statement of security guard Punit Kumar was
recorded to the effect that on 17.06.2025 at about 09.15 AM, he
and his co-worker Rakesh were sitting outside the bathroom in
the OHB(A); at that time, a commotion was heard. He and
Rakesh opened the gate of the bathroom; Rakesh went inside and
saw that one boy Karan was lying unconscious on the floor.
Karan was taken to Hindu Rao Hospital. When he (Punit Kumar)
checked the CCTV Footage, it was found that scuffle was going
on between deceased Karan and accused/applicant Mohd.
Saddiq. At that time, accused Rahul Kumar @ Anshu gave
several fist blows to deceased Karan due to which he fell down
and became unconscious.
The involvement of accused/applicant Saddiq is

clearly reflected from the CCTV footage. PW2 ‘FH’ deposed
before the Court that on the day of the incident, a quarrel had
taken place between deceased Karan and accused/applicant
Saddiq @ Ikka. They both exchanged fist blows with each other.
He correctly identified the accused/applicant Saddiq in the Court.
PW3 Tanveer Alam also deposed that the accused/applicant
Saddiq and deceased Karan used to quarrel often and on the day
of the incident, some altercation was going on between them. He
further stated that on the day of the incident while bathing, since
deceased Karan had put his head under the shower,
accused/applicant Saddiq had abused him after which a quarrel
had taken place between them.
The allegations against the accused are grave and
serious in nature. Another eye witness and other prosecution
witnesses are yet to be examined.
Considering the nature and gravity of the offence, I
do not consider it to be fit case for grant of bail. The bail
application is accordingly dismissed.
Copy of the order be given dasti to Ld. Counsel for
accused/applicant.
Copy of the order be sent to concerned jail.
