Present :- Sh. Vijay Kumar, Ld. counsel for the DH.
An application has been filed by DH for transfer the
present execution petition.
It is further submitted that JD i.e. Ms. Pooja Sinha
resides within the territorial jurisdiction of South West District,
Dwarka, Delhi and therefore, a transfer certificate may be issued
for the purpose of re-filing the execution petition in the court
having territorial jurisdiction. The transfer certificate is prayed
for.
Heard. Perused.
As the residence of JD is situated beyond
jurisdiction of this court, it is necessary and expedient that the
execution be transferred to Civil Courts at South West District,
Dwarka Court, Delhi so that the same can be executed at the
address of the JD, which is situated within the local jurisdiction
of Civil Court at South West District, Dwarka Court, Delhi.
Transfer certificate is issued for execution of the
decree through the Ld. Principal District & Sessions Judge, South
West District, Dwarka Court, Delhi.
In view of the same, application of the DH U/s 151
CPC is allowed and disposed of accordingly.
Present execution petition is disposed of.
File be consigned to Record Room. As requested
transfer certificate be given dasti.
