An application under order 1 rule 10 CPC moved on behalf of the
plaintiff for correction of the name of the defendant no. 4.
Ld. Counsel for the defendants have no objection if the above
said application be allowed.
Heard. Perused.
The above said application has been moved under the wrong
provision, accordingly, I deem it appropriate to deal with the same under
section 151 CPC. In view of the submissions, the application is hereby stands
allowed. The amended memo of parties has already been filed.
Reply to the application under order 9 rule 7 CPC read with
section 151 CPC as well as rejoinder to the WS of the defendants no. 4 to 7
alongwith certain documents have also been filed. Copy supplied today.
Ld. Proxy Counsel for the defendant no. 1 and 2 seeks some time
to go through the same.
At request, matter is adjourned.
