Heard on consideration.
Ld. counsel for the appellant submits that by way of
the present appeal, the appellant seeks to challenge only certain
findings recorded in the judgment and decree dated 02.06.2025
passed in Suit No. 597433/2026, titled
Rajeev Sachdeva vs. Kiran
Bala by the Court of Ld. Sr. Civil Judge, Central District. It is stated
that although the suit ultimately stood decreed in favour of the
appellant, certain issues have been decided adversely against him,
and the appellant seeks to assail those findings alone. Ld. counsel
fairly concedes that present appeal has not been preferred against the
entire judgment and decree dated
Upon query from this Court as to how the present
appeal is maintainable when it is directed only against certain
findings and not the decree as a whole, ld. counsel submits that the
present appeal may be treated as cross-objections under Order XLI
Rule 22 CPC.
However, on further query from the Court as to
whether any appeal against the said judgment and decree has been
filed by the respondent and is pending before this court, ld. counsel
submits that the respondent has indeed preferred an appeal against
the decree dated 02.06.2025, which is presently pending before the
Court of Ms. Shagun Sharma, Ld. District Judge-12, Central, Delhi.
Having stated so, he prays that the present appeal also be transferred
to the said Court so that it may be treated and considered as cross-

objections in that appeal.
In view of the submissions and considering that cross-
objections, if any, can only be adjudicated in the appeal already
pending before the Appellate Court, this Court is of the considered
opinion that the present appeal, if maintainable at all, can only be
dealt with in the said pending appeal before Ld. District Judge-12,
Central.
Accordingly, the present matter be placed before the
Ld. Principal District & Sessions Judge (HQ), Tis Hazari Courts,
Delhi, on 10.11.2025 at 02:00 PM for appropriate orders.
Ahlmad is directed to send the file, complete in all
respect before the NDOH.
Parties are directed to appear accordingly.
