Present: Sh Ankit Gupta (through VC) & Ms Niharika Singh Ld counsel for
the appellant a/w Sh Sachin Gupta.
Sh Chirag Tuli SPA on behalf of respondent.
The present appeal has arisen out of the order dt 17.08.2024 vide
which the application filed under Order 39 Rule 1 & 2 CPC by the plaintiff had
been allowed.
Today, an application u/s 151 CPC has been filed seeking
permission of the court to withdraw the present appeal on the ground that the
parties have compromised the present matter. Alongwith the present application
the court has been handed over with the compromise deed whereby the parties
have amicably resolved all their disputes and have agreed to withdraw all their
pending matters as detailed in para 4 of the said deed.
The parties i.e. Sachin Gupta and Chirag Tuli are present before the
court who submit that they are representing all the parties and the compromise
deed has been executed with full accord and full consent of the parties.
Separate statement of the parties are recorded in this regard.
In view of the same, the present appeal is dismissed as
withdrawn as compromised.
File be consigned to record room after due compliance.
Earlier date i.e. 20.04.2026 stands cancelled.
TCR be sent back to the court concerned.
