Present: Ld. Counsel Mr. Luv Mahajan for the DH.
Report of Nazir perused.
It shows that there is no stay order on the execution of
decree.
DH has filed an application for deposit of deficient
court fees on decree of damages along with the application DH has
filed court fee of Rs.4600/-. The same be placed in the main suit
along with copy of this order. Application stands disposed off
accordingly.
Issue warrants of possession in respect of suit property
i.e. shop no.1 on the ground floor, without roof rights forming part
of property no.B-1619, ad-measuring 13 sq.mtrs, situated at Shastri
Nagar, Delhi-110052 as shown in the site plan Ex.PW-1/11 on
filing of PF. Warrants of attachment be also issued against the
movable articles of JD to the extent of decreetal amount.
The bailiff is directed to execute the warrants of
possession by breaking open the locks and door, if premises is found
locked. The bailiff shall also seek assistance from the local police in
case there is any resistance to the execution of warrants of
possession.
SHO of police station concerned is directed to provide
adequate security to the bailiff in execution of the warrants of
possession.
