Present: Ld. Counsel Mr. Rohit Sharma for the DH along with
DH no.2 Mr. Shikhar Jaiswal.
JD in person.
It has been submitted by the counsel for DH that
warrants of possession have been executed as DH has received the
possession of the suit shop. It is further submitted that matter has
been settled with regard to the mesne profits and the articles of the
JD have been returned to him.
Let the statement of the parties be recorded.
Statement of Mr. Shikhar Jaiswal, DH no.2.
on SA.
I am the DH no.2 in the execution petition and have been duly
authorized by DH no.1 to make this statement. I state that I have
received the possession of the suit property in execution of warrants
of possession issued by the court. The DH have settled the disputes
with regard to the mesne profits/damages with the JD and have
received Rs.2,25,000/- in full and final settlement of all claims
between the parties. The articles of the JD have been handed over to
him and now there remains no disputes between the parties and the
execution petition may be disposed off as satisfied.

Statement of Sh. Jasvinder Singh, JD
on SA.
I am the JD in the present execution petition. I have
heard the statement made by the DH no.2. I admit that the matter
has been amicably settled between the parties and I have paid
Rs.2.25 lakhs to the DH as full and final settlement of disputes. I
have also received my articles from the DH and now there are no
disputes pending between the parties. I have no objection, if the
execution petition is disposed off as satisfied.
