As per the record, WS was filed by the defendant on
29.10.2025. Copy supplied to Ld. Counsel for plaintiff. Perusal of
the WS shows that it is annexed by a form of list of documents but
same vaguely mentions about the documents annexed without any
further description as to on what documents defendant intends to rely.
Ld. Counsel for defendant is directed to file a proper list of documents
on the next date of hearing specifically mentioning description of
each document he intends to rely along with pagination.
Put up for replication, if any, admission/denial of
documents, framing of issues and arguments on application under
Order 39 Rule 1 & 2 CPC on 19.01.2026. Let proposed issues, if any
as well as affidavit with respect to admission/denial of documents on
behalf of the parties be filed with advance copy to the opposite party
at least a week prior to the next date of hearing. Parties are directed
to bring originals of the documents which they have relied upon in
support of their claim or defence and have filed alongwith pleadings.
