record. Spare copy of the same is placed on record. Defendant
may collect the same from court staff.
Parties submit that they have already admitted or
denied the documents of each other in their pleadings, so no
separate evidence of admission or denial is required.
Accordingly, filing of affidavit of admission/denial is dispensed
with.
From the pleadings and averments made on behalf
of both the parties, following issues are framed:-
1. Whether sale deed dated 18.12.2021 in favour of the
plaintiff and also sale deed in favour of previous owner namely
Sangeeta Gupta and Varun Gupta dated 07.01.2019 is null and
void? OPD.
2. Whether plaintiff is entitled to possession of the suit
property i.e. one shop situated at Ground Foor, measuring 126
sq.ft. situated in property bearing 4759, Plot No. 5, Deputy Ganj,
Sadar Bazar, Delhi-110006, as prayed for? OPP.
3. Whether plaintiff is also entitled to arrears of license
along with interest, as prayed for and if so, for what period and
at what rate? OPP.
4. Whether plaintiff is also entitled to mesne profit/user
charges along with interest, as prayed for and if so, for what
period and at what rate? OPP.

No other issue arises or pressed for.
Put up for PE on 23.03.2026.
Parties are directed to file the list of witnesses within
15 days from today with advance copy to opposite party. Plaintiff
is directed to file evidence by way of affidavit and to supply
advance copy of the same to the opposite party at least 10 days
prior to the next date of hearing.
