setting aside the ex-parte judgment and decree dated 07.01.2025.

Sh. Sahil Goel, Ld. Counsel for the non-aplicant
alongwith SPA of the non-applicant.
An application U/s 5 and 14 of Limitation Act for
condonation of delay in filing the application is also filed. Copy
supplied to opposite party.
An application U/s 151 CPC for stay of operation of
ex-parte impugned judgment is also filed. Heard. The decretal
amount has already been released to the SPA of the decree holder
upon furnishing an undertaking, therefore, the application for
stay of operation of exparte impugned judgement stands
dismissed, being infructuous.
Let reply of applications U/o IX Rule 13 CPC and
U/s 5 and 14 of Limitation Act be filed within two weeks with
advance copy to the opposite party. Let file of main suit bearing
CS (Comm) No. 1510/2023 be also called from record room.
At request, put up for arguments on the pending
applications on 13.10.2025.
A copy of the order be given dasti to the parties as
prayed.
