Ld. Counsel for defendant has filed an application u/s 151 CPC for
placing on record additional documents i.e. extract of board resolution dated
22.12.2016 (it appears due to typographical error same has been mentioned as
22.12.2026 in the application).
It is averred in the application that due to inadvertence the same
could not be placed on record earlier.
Heard.
Vide the said resolution Sh. Shubhankar Nagar, Director has been
authorised, inter-alia, to file Written Statement and defend the present suit.
However, the same ought to have been filed by the Written Statement. As per the
record, WS was filed in the year 2023 and now the case has progressed to the
stage of defendant evidence. Still, in the interest of justice, considering the facts
that evidence of the defendant is yet to begin and plaintiff have every right and
opportunity to cross examine the defendant on this resolution, the present
application is allowed subject to cost of Rs. 10,000/- to be paid by the defendant
to the plaintiff.
Ld. Counsel for defendant has also filed list of witnesses and
evidence by way of affidavit of DW1 and DW2. Copy supplied.
At request, put up for DE on 31.07.2026.
