Matter is listed for disposal of defendants’
application U/o VIII Rule 1A(3) r/w Section 151 CPC as well as
DE.
Counsel for defendants submits that he does not
wish to press for application U/o VIII Rule 1A(3) r/w Section
151 CPC filed on behalf of defendants as he wants to file an
application under appropriate section applicable to Commercial
Courts Act and prays that same be dismissed as withdrawn. He
has made endorsement in this regard on application itself. In view
of the same, application U/o VIII Rule 1A(3) r/w Section 151
CPC filed on behalf of defendants is dismissed as withdrawn.
Evidence affidavit of Sh. Gurmeet Singh, defendant
no.2/partner of defendant no.1, alongwith Certificate U/s 65B of
IE Act filed on behalf of defendants on 16.07.2024, have been
put up. Counsel for defendants prays for adjournment to tender
the same in evidence as talks for settlement are going on between
the parties.
On joint request, matter adjourned for tendering the
affidavit of DW1/Gurmeet Singh and his cross-examination on
22.08.2024. Report regarding settlement, if any, be also furnished
on said date.
