Counsel for Plaintiff submits that the time period to file
rejoinder by the Plaintiff is still surviving.
File taken upon on the application under Order 13-A r/w Order
12 Rule 6 CPC filed on behalf of Plaintiff praying for passing of summary
Judgment on behalf of Plaintiff. Copy supplied to other side. Ld. Counsel
for Plaintiff has also filed Judgment of Hon’ble Delhi High Court in KR
Impex Vs. Punj Lloyd Ltd. (DOD as 08.01.2019) along with the application.
Ld. Counsel for Plaintiff on being put a query as to the
maintainability of application post framing of issues by the Court, submits
that the same is maintainable in view of the ratio of law discussed in the KR
Impex (supra), more particularly the matter before this Court is a clear cut
matter of the facts being admitted by Defendant, as is seen from the
statement of Proprietor of Defendant dated 27.11.2025 recorded before the
Court.
Ld. Counsel for Defendant submits that he has received the
copy of said application and seeks time to file reply to the same. The
Judgment relied upon by Plaintiff be supplied to Defendant.
Be put up for arguments on the application of Plaintiff under
Order 13-A r/w Order 12 Rule 6 CPC on 15.01.2026.
