Vide separate order, the above application of
defendant no.1 under Order 1 Rule 10(2) CPC seeking striking
off names of defendants no.2 to 5 has been allowed and as a
result thereof, the other application dated 04.03.2023 filed on
behalf of plaintiffs under Order 37 Rule 2(3) CPC seeking
passing of a decree against the said defendants for their failure to
put in appearance in the present case also becomes infructuous
and is being dismissed as such.

List the matter now on 22.05.2024 for arguments on
the pending application under Order 37 Rule 3(5) CPC of
defendant no.1 seeking leave to defend and also on the
application seeking condonation of delay in filing of the same.
Let amended memo of parties after deleting the names of
defendants no.2 to 5 be filed by plaintiffs by next date of hearing.
