As per record, summons served upon defendants on 09.10.2023 and defendants have already entered their appearance on 19.10.2023 i.e. well within the statutory period. Today an application under Order 1 Rule 10(2) CPC for striking off the names of the improperly joined defendants no.2 to 5 filed. An application under Order XXXVII Rule 4 CPC filed for issuing summons of judgment to the defendant. It is submitted that the Statement of Truth has already been filed on behalf of plaintiff. It is accordingly prayed that the application for issuance of summons for judgment be allowed and the summons for judgment as per Order XXXVII Rule 3 Sub Rule 4 read with Section 151 CPC be issued against the defendant. As per record, the defendants have already entered appearance. Issue summons for judgment to all defendants on taking appropriate steps by the plaintiff as prescribed in Form no.4A in Appendix B, as per Order XXXVII Rule 3(4) CPC, through all modes for 05.01.2024 (Sanjeev Kumar Singh) District Judge, Commercial Court-13 Central District, Tis Hazari Courts, Delhi/30.11.2023/(rk) -- 1 of 1 --
