RAJ KUMAR JAIN
Vs. MUNICIPAL CORPORATION OF DELHI
21.04.2025
Present: Sh. Yogesh Sharma, Ld Counsel for the DH .
Sh. Ankit Kaushal, Ld Counsel for the JD/MCD
alongwith Sh. Shail Tyagi, AE (M2), Shahdara
Zone/MCD.
Perusal of record shows that on the last date of hearing
matter was adjourned for filing the upto date outstanding to be
payable to the workman. It further transpires from the record that
on the last date of hearing it got recorded that the entire decretal
amount alongwith accrued interest is still outstanding. However, at
this stage Ld Counsel for the Decree Holder submits that he has
already received the decretal amount and the present proceedings
are infact qua the interest component only which has accrued in
favour of the Decree Holder on account of delayed payment . In
view of the submissions in the order dated 21.03.2025 the
expression “entire decretal amount alongwith the accrued interest”
be read as “ accrued interest” and the said order stands corrected
accordingly.
At this stage, calculation filed on behalf of Decree
Holder whereby the accrued interest has been shown as
Rs.489976/-. To this Ld Counsel for the MCD seeks a short
