Fresh complaint case received by way of assignment. It be checked and
registered.
Present : Sh. Praduman Rai, Ld. Proxy Counsel for the
complainant alongwith Sh. Saurabh, Legal Retainer.
The present case pertains to impugned bill dated
25.06.2026, due on 10.07.2026 and print date 09.07.2026, for a
sum of Rs. 81,594/-, raised on the basis of raid conducted on
24.06.2026 by the officials of complainant company and
consequently, the present case has been filed today i.e.
05.08.2026.
On being enquired, it is submitted by the Ld. Proxy
Counsel for the complainant that the present matter has not been
settled till today with the accused and the fact regarding age of the
accused has not been mentioned in the complaint. On being
further enquired as to how many cases / inspections are / were
pending with respect to premises in question / accused, Ld. Proxy
Counsel for the complainant company submits that he is unable to
provide the said details.
Heard. Record perused.
As per section 223(1) BNSS, 2023, cognizance of
the offence can only be taken after giving the accused an
opportunity of being heard.
Accordingly, issue notice to the accused, through
SHO concerned and in addition dasti be given, on filing of PF
within seven days from today, returnable for the next date of
hearing. Further, if in the meanwhile matter has been settled
between the parties, then complainant is directed to intimate
regarding the settlement to the court immediately along with copy
of order. Complainant is also directed to provide list of cases /

inspections, if any, which are / were pending with respect to
premises in question / accused on the next date of hearing.
Copy of complaint be also filed along with PF.
Put up for report on the notice on 27.10.2026.
