Fresh claim petition has been received from filing section. It be
checked and registered.
Present : Ms. Taiyaba, Ld.Proxy Counsel for the petitioner.
Heard. Perused.
Perusal of the case file reveals that the accident in
question took place on 27.07.2025 near Naharpur Tiraha,
Manesar, Gurugram, Haryana at about 08:20 pm.
However, the insurance company has its office within
the jurisdiction of this court.
The petitioner is directed to take steps for
impleadment of Nodal Officer of insurance company, as
respondent no. 4, in terms of the case titled as “Gohar
Mohammed Vs. Uttar Pradesh State Road Transport Corporation
& Others” 2022 SCC Online SC 1769. Further, the petitioner(s)
is given time to apply to the concerned Tribunal to send the
statutory petition under Section 166(4) of The M. V. Act (along-
with documents/FAR/IAR/DAR) to the present Tribunal and to
comply with the other directions mentioned in paragraph no. 64
(xii) of above cited judgment of
Hon’ble Supreme Court of India,
if required in present matter.
He undertakes that only this claim petition will be
pursued by the petitioners. The petitioner is directed to file an
affidavit in this regard along with the certified copies of the

criminal record by the NDOH.
To expedite the present proceedings and on the
undertaking of Ld. Counsel for the petitioner, notice be issued to
all the respondents on filing of PF/RC for the next date of
hearing. However, final claim order will be subject to the
production of the appropriate order by Ld. Counsel for the
petitioner from the concerned court of MACT, Manesar,
Gurugram, Haryana.
Put up for further proceedings for 21.11.2025. Copy
of this order be given dasti.
