Petitioner in person.
This is a petition for grant of probate/letters of administration of
estate of deceased late Sh. Sohan Lal in terms of Will dated 12.06.2013.
Original Will dated 12.06.2013 has been filed by the petitioner.
A bare perusal of the petition shows that same is not verified by one
of the attesting witnesses of the Will in terms of Section 281 of Indian
Succession Act, 1925.
On a query put by this court regarding same, Ld. Counsel for the
petitioner submits that petitioner will summon the said attesting witnesses to
prove the Will.
Keeping the aspect of maintainability of the present petition in the
present form open at this stage (for non-compliance of Provisions of Section 281
of Indian Succession Act, 1925) at request of Ld. Counsel for the petitioner, let
notice of the petition be sent to the respondents No. 2 to 6 and to the respondent
no. 1/State through concerned District Collector/SDM (Daryaganj), with
direction to file a valuation report with respect to the properties in question on
filing of PF & RC.
Citation may also be published in English daily “The Statesman” &
Hindi daily “Veer Arjun” calling upon all the persons claiming interest in the
estate of the deceased for filing objection, if any, before grant of Probate/Letters
of Administration of the estate of deceased Late Sh. Sohan Lal S/o Sh. Hariya
Ram in terms of Will dated 12.06.2013.
Copy of the citation be also displayed on the notice board of court
premises and also in the office of Collector of Distt/concerned SDM (Daryaganj)

where the properties in question are situated.
The petitioner is directed to deposit the publication charges within
fifteen days from today. Let a copy of this order be given dasti to the petitioner
so as to facilitate her in deposition of the publication charges.
Put up for further proceedings on 27.11.2025.
