The record shows that NBW against Neha @ Moti
was ordered to be issued on 29.05.2026, which was not regular
date as 28.05.2026 was declared holiday and file was taken up on
29.05.2026.
In these facts and circumstances and on request,
NBW against accused Neha @ Moti is cancelled.
IO submits that on 06.09.2023, charge-sheet was
filed against accused persons namely Zahid and Neha and
accused Rahul @ Judi was kept in Column no. 12 but he was not
summoned. IO further submits that the supplementary charge-
sheet was filed only against accused Toofan.
As per record, charge-sheet qua accused Md. Zahid
and Neha was filed on 06.09.2023, keeping the accused Rahul @
Judi in Column No. 12. Thereafter, vide order dated 11.12.2023,
cognizance of the offence U/s 21 & 25 of NDPS Act was taken
and copies were supplied to accused Md. Zahid, who was
produced from JC and summons were issued only to accused
Neha, being on bail. However, accused Neha also appeared

in post lunch session and copies were supplied to her.
Subsequently, supplementary charge-sheet only qua accused
Toofan Singh was filed on 27.09.2025.
Therefore, it is clear that accused Rahul @ Judi was
never summoned to face trial in the present case.
On request, list the matter for arguments on the point
of charge on 14.12.2026. IO shall remain present on the next
date of hearing.
