Pursuant to service of summons, the counsel for the defendant Sh. N.C Shahi
has entered appearance on behalf of all the three defendants.
On instructions, counsel for the defendant no. 1 and 3 submits that the
defendants are not in the process of selling, alienating, transferring or creating third party
rights or interest in the suit property since they are the owners of the suit property and are
residing in the suit property.
It is further submitted that defendant no. 2 is not residing in the suit property
and she is staying at Moradabad in her matrimonial house.
Accordingly let a status quo be maintained with respect to title and possession
of the suit property till the NDOH.
Let a written statement be filed by the defendants within 30 days from today
with advance copy to the other side.
Let a reply to the application under Order 39 Rule 1 and 2 CPC be also filed
on or before the NDOH with advance copy to the other side.
Renotify the matter for completion of pleadings and arguments on the
application under Order 39 Rule 1 and 2 CPC on 14.10.2024.
