Present: Sh.Abhijeet Vikram Singh, Ld. Counsel for the
revisionists.
Ld. Counsel for the revisionist has informed that the
revision petition is within limitation as the summons were served
upon the revisionists only on 04.04.2026 after which the
revisionists have applied for certified copy of the complaint as
well as the impugned order.
It is not clear as to whether summons were sent to
the revisionists before 04.04.2026 and if yes, whether they were
served or not. Accordingly, the question of limitation is kept
open.
Arguments on the application for stay of the trial
court proceedings have been heard.
Put up for orders at 4:00 pm.

Order:
Ld. Counsel for the revisionists submit that the next
date before the ld. trial court is fixed for framing of notice;
prejudice will be caused to the revisionists if proceedings before
the ld. trial court are not stayed. Ld. counsel for the revisionists
further submitted that in a similar case the Hon'ble High Court of

Delhi has set aside the order of Ld. ACJM.
Seemingly, no notice was issued and no order was
passed on the application for condonation of delay filed by the
respondent before the ld. trial court. Accordingly, the proceedings
before the ld. trial court are stayed till the NDOH.
Notice of the revision petition be issued to the
respondent on filing of PF/RC for 25.09.2026.
Copy of this order be sent to the ld. trial Court for
information and compliance.
Copy of this order be given dasti to the ld. counsel
for the revisionists.
