Bail application not filed.
It is submitted by the parties that connected matter of the
accused is pending consideration before Mediation Centre for
25.11.2025 and there are chances of settlement of the present case also
along with said connected matter.
NBW issued against the accused on 08.10.2025 were
stayed vide order dated 20.11.2025 till today.
In view of the submissions made by the Ld. Counsel for
the accused, NBW issued against the accused are hereby cancelled.
Accused is warned to remain careful in future.
Arguments on the point of notice stand heard.
After considering the allegations contained in the
complaint case and the documents including Inspection Report, Load
Report, Seizure memo, CD containing videography of the inspection
allegedly carried out at the site, etc., Court is of the view that prima
facie case is made out against the accused for the offence punishable
under Section 135 of Electricity Act. Accordingly, notice in terms of
Section 274 BNSS framed against accused for the said offence, to
which accused has pleaded not guilty and has claimed trial.
Put up for awaiting outcome of proceedings before
Mediation Centre otherwise for PE on 24.03.2026.
