In respect of disposal of the application now, it is stated
by Ld. PP that in view of the findings of Hon’ble Supreme Court of
India in case of Roma Ahuja Vs State & Ors, 2026 INSC 336, the
report can be considered as filed within limitation. It is further
stated that assistance of SHO is required for submissions on the
aspect of cognizance.
After going through the judgment of Roma Ahuja as
relied upon, I found myself agree with the contention of Ld. APP
that cognizance can be taken by the court on the report and same is
not beyond prescribed period of limitation.
Let Inspector Mukesh Kumar Antil be summoned to
assist the court on the aspect of cognizance.
Copy of the order be sent to the Office of Ld.
Commissioner of Police, Delhi to apprise the court about the action
being taken for the supervisory lapse of ACP and DCP if any and to
apprise the court about the outcome of the action taken against IO
and SHO.
Put up on 08.06.2026 for appearance of SHO and
submissions on cognizance.
