Present: Sh. Deepak Kumar Jha, Ld. Addl. PP for the
State.
Sh. Hitanshu Uttreja, Assistant Manager (Legal) of
complainant company.
Presence of Inspector Mukesh Antil upon whose
request matter was adjourned on last date of hearing, is awaited till
03:00 pm.
The court is apprised about the flaws in the
investigations qua the examination of witnesses in respect of
videography/ photography of the inspection proceedings. It is the
submission of Manager of the complainant company that if orders
are passed on the report then the same will defeat the justice and
will prejudice the case of the complainant company due to inaction
of the police. It is submitted that first the action was taken on the
complaint given on 16.01.2020 with delay and thereafter proper
statement of the witnesses has not been recorded and admissible
evidence has not been collected.
Considering the status of the facts where Inspector
Mukesh Antil by whom the report was filed upon completion of
investigation has failed to assist the court in appreciating the report

and the submissions made on behalf of complainant today, let the
matter be adjourned. The presence of Inspector Mukesh Antil be
secured through Office of Ld. Commissioner of Police, Delhi.
The Action Taken Report in respect of supervisory
lapse in terms of order dated 14.05.2026 be also filed and if no such
action has been taken then the grounds for not taking the action be
apprised to the court.
Put up on 12.08.2026 awaiting the report.
