Fresh criminal appeal received by assignment. It be
checked and registered.
Present: Appellant in person with Counsel Sh. M.G.Salaudin.
This is an appeal against the judgment dated
25.01.2024 and order on sentence dated 03.07.2024 vide which
the appellant/convict has been sentenced to undergo Rigourous
Imprisonment for 01 year for offence U/s 411 IPC along with
fine of Rs.7000/-, out of which Rs.6,028/- shall be adjusted
towards prosecution expenses and in default of payment of fine,
convict to undergo further SI for 01 month. Benefit of Section
428 CrPC, if any, be granted to convict.
Ld. Counsel for appellant/convict submits that an
application u/s 389 Cr.P.C. seeking suspension of sentence and
grant of bail till decision of the present appeal has also been filed
along with present appeal.
Arguments on said application heard.
Keeping in view of the totality of facts and
circumstances, Impugned judgment and order on sentence are
stayed till the disposal of the present appeal and the sentence
awarded by the Ld. Trial Court is suspended till disposal of
the present appeal. Appellant/convict is admitted to bail till
disposal of present appeal on his furnishing personal bond in the
sum of Rs. 20,000/- with one surety in the like amount to the
satisfaction of this Court as well as on deposit of entire fine

amount within 10 working days from today before the Ld. Trial
Court.
The receipt for deposit of fine amount be placed on record
on or before the next date of hearing.
Requisite bail bond and surety bond furnished.
Accepted during the pendency of the appeal.
Appellant/convict be released at once during the
pendency of the appeal.
TCR be summoned for NDOH.
Copy of present appeal be supplied by the
appellant/convict to the State today itself.
To come up for arguments on 14.11.2024.
Copy of this order be given dasti to Ld. Counsel for
accused/appellant and be also sent to Ld. Trial Court.
