This is an application for release of original National Saving
Scheme in sum of Rs. 10,000/- filed on behalf of surety Smt.
Mansi.
Present : Ms. Nimmi Sisodia, Ld. Substitute Addl. PP for the
State.
Ms. Roma Singh, Ld. Counsel for applicant/surety.
Ld. Counsel for applicant/surety Smt. Mansi submits
that Smt. Mansi stood surety for accused Pintu @ Prem Chand
and she had filed bail bonds under Sec. 437A Cr.PC. She further
submits that the judgment in the present case was pronounced by
this court on 07.09.2024 and the surety bonds were valid for a
period of six months only and the said period of six months has
already expired and hence she should be discharged as a Surety
from the present case and original National Saving Scheme in
sum of Rs. 10,000/- should be released to the surety.
Ld. Substitute Addl PP for the State submits that she
has no objection if the surety is discharged in the present case
and no appeal has been filed in the present case.
I have heard the submission and perused the record.
As per the record, judgment in the present case was
pronounced by this court on 07.09.2024. The bail bonds filed by
the surety under Sec. 437A Cr.PC were valid only for a period of

six months. The period of six months of the validity of surety
bonds has already expired. No appeal has been filed in the
present case.
In view of the facts and circumstances, the present
application is hereby allowed.
Surety namely Smt. Mansi is hereby discharged
from the present case. Original National Saving Scheme in sum
of Rs. 10,000/- be released to surety Smt. Mansi against
acknowledgment after verifying her identity.
At this stage, Ld. Counsel for applicant/surety Smt.
Mansi submits that she stood surety for accused Manoj at the
time of grant of regular bail also and she had filed bail bonds and
at that time endorsement was made on the FDR produced by the
surety which should be cancelled.
Since the jdugment in the present case has already
been pronounced, there is no requirement of endorsement on the
FDR
At this stage, Ld. Counsel for surety has produced
original FDR having endorsement of court dated 12.08.2013. The
endorsement is hereby cancelled. The original FDR has been
returned to Ld. Counsel for surety.
The application is disposed off accordingly.
Copy of this order be given dasti to the surety.
