JD unserved for want of filing of fresh address.
An application filed on behalf of DH for
furnishing fresh address of the JD.
Heard. In view of the averments made in the
application as well as submissions made by counsel for DH,
application is allowed. Fresh address of JD is taken on record by
way of amended memo filed alongwith the application.
Nazir has submitted the report. As per Nazir's report,
the execution has been filed after two years of passing of the
award and there is no stay of the proceedings. JDs have not
deposited any amount till date.
Fresh notice of the execution petition be issued to
the JD at the fresh address filed today, on filing of PF/RC/ speed
post and approved courier.
Steps be taken within three weeks from today. Nazir
shall issue the summons within two weeks thereafter and if DH
fails to take the steps within three weeks from today, process
shall not be issued unless the delay is condoned by the Court.
JD shall file the reply within 30 days from the date
of service.
Be listed awaiting for appearance/reply on
05.03.2024.
