The application is strongly opposed by the AR for
the complainant company with further request to take the accused
into custody as the matter has been delayed since long due to the
conduct of the accused as on earlier occasion also i.e. on
31.07.2025, NBW issued against the accused were cancelled
subject to payment of fine of Rs.100/-. Further, notice in the
present case was framed on 03.11.2025 and on the last date of
hearing i.e. 25.02.2026, PW Rakesh Saini was present who was
discharged unexamined as accused submitted that settlement talks
are going on with the complainant but has failed to file any
settlement report.
Arguments on the application heard. Record
perused.
In view of the submissions made by the AR for the
complainant company and the averments made in the application,
the application stands allowed and the NBW issued against the
accused are cancelled subject to payment of fine of Rs.500/-.
Accused is warned to remain careful in future.
Passover sought by the Ld. Counsel for the accused
