Ld. Counsel for applicant Ms. Rashmi Tiwari states that he has
already received the copy of two applications dated 02.09.2025 i.e. under
Order 39 Rule 2 A r/w Section-151 CPC causing breach of
ex-parte status
quo Order dated 01.08.2025 and another being under Order 39 Rule 4 r/w
Section-151 CPC.
Ld. Counsel for Respondent (plaintiffs herein) has filed reply
to the application of applicant Ms. Rashmi Tiwari under Order 1 Rule 10
r/w Section-114 along-with Order 47 Rule 1 r/w Section-151 CPC (running
upto 86 pages). Additional affidavits of Mr. Jinender Kumar Jain, Mr. Jai
Bhagwan Jain and Mr. Surender Kumar Jain also sought to be filed on
record. Copy supplied to the applicant Ms. Rashmi.

Ld. Counsel for Respondent Mr. Manoj Tiwari has also filed
reply to the application of Ms. Rashmi Tiwari under Order 1 Rule 10 r/w
Section-114 along-with Order 47 Rule 1 r/w Section-151 CPC (running
upto 75 pages).
Arguments heard on the application of Applicant Ms. Rashmi
Tiwari as addressed by ld. Counsel for the parties at length. Ld. Counsel for
Respondent Mr. Manoj Tiwari has placed reliance upon the Judgment of
Hon’ble Delhi High Court in ‘Asma Parveen Vs. Municipal Corporation of
Delhi & Ors. (DOD as 03.02.2025)’ in support of his submissions.
List the application under Order 1 Rule 10 r/w Section-114
along-with Order 47 Rule 1 r/w Section-151 CPC of Applicant for Orders
on 19.09.2025. Written synopsis, if any, be filed by parties on or before
next date.
The matter shall be taken up thereafter for arguments on the
